Calculation of wages for incomplete month\u2019s work (New Section 18A)<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d48071f elementor-widget elementor-widget-text-editor\" data-id=\"d48071f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #000000; font-family: Poppins, sans-serif; font-size: 18px;\">The Employment Act Malaysia 2022 indicates the calculation of wages where employee did not complete a whole month service under these conditions:<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-96df399 elementor-widget elementor-widget-text-editor\" data-id=\"96df399\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ul><li><span style=\"color: #000000; font-family: Poppins, sans-serif; font-size: 18px;\">employees join the company after 1st day of the month.<\/span><\/li><li><span style=\"color: #000000; font-family: Poppins, sans-serif; font-size: 18px;\">employee is terminated before the end of the month.<\/span><\/li><li><span style=\"color: #000000; font-family: Poppins, sans-serif; font-size: 18px;\">employee took \u201cleave of absence without pay\u201d for one or more days of the month; or<\/span><\/li><li><span style=\"color: #000000; font-family: Poppins, sans-serif; font-size: 18px;\">employee took leave of absence due to national service.<\/span><\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1610f43 elementor-widget elementor-widget-text-editor\" data-id=\"1610f43\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"color: #000000; Employment of Foreign employee<\/p><p class=\"elementor-image-box-description\">Labour law Malaysia has stricken rules on foreign employee employment and it is now compulsory to obtain prior approval before employing a foreign employee.<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-44f1403 e-con-full e-flex e-con e-child\" data-id=\"44f1403\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t<div class=\"elementor-element elementor-element-5e37404 elementor-widget elementor-widget-image-box\" data-id=\"5e37404\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"image-box.default\">\n\t\t\t\t\t<div class=\"elementor-image-box-wrapper\"><div class=\"elementor-image-box-content\"><p class=\"elementor-image-box-title\">2. Termination of Foreign Employee<\/p><p class=\"elementor-image-box-description\">Employment Act Malaysia 2022 requires employer to inform the labour office within 30 days after a foreign employee is terminated, and in the case where foreign employee quit his job or disappears, employer should notify the labour office within 14 days.<\/p><\/div><\/div>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-0c6ae0f e-flex e-con-boxed e-con e-parent\" data-id=\"0c6ae0f\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-7372afc elementor-widget elementor-widget-heading\" data-id=\"7372afc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t\t<p class=\"elementor-heading-title elementor-size-default\">Other amendments in EA include:<\/p>\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-82a49da elementor-widget elementor-widget-text-editor\" data-id=\"82a49da\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t\t\t\t\t\t<ol><li>Substituting the term \u201cservant\u201d to \u201c<strong>employee<\/strong>\u201d.<\/li><li>Employment Act Malaysia 2022 has added new section to <strong>define Forced Labour and that it is an offence if employer conducted such act<\/strong>. If convicted, the employer is liable to a fine not exceeding RM100,000 or imprisonment not exceeding 2 years or both.<\/li><li><strong>The deletion of section 69B<\/strong>, additional power of the Director-General to investigate dispute case for employee salaried more than RM2000 to RM5000 is removed.
