REGULATORY UPDATE: Shifting from Permit to Registration
Historically, to determine whether software was compliant, the BIR usually scheduled visits to the company seeking accreditation for BIR CAS and required a demo of the system. The company applying for accreditation and the software vendor had to be present during this demo.
This process has been officially superseded by Revenue Memorandum Circular (RMC) No. 5-2021, which was issued on January 8, 2021, and provides simplified policies on the application for registration of Computerized Accounting System (CAS), Computerized Books of Accounts (CBA), and/or its components (collectively known as the “System”). RMC No. 5-2021 supersedes previous circulars and portions of Revenue Memorandum Order (RMO) No. 29-2002 that are inconsistent with its provisions.
The New Registration Policies
All taxpayers intending to use CAS, CBA, and/or its components, including Electronic Storage System (ESS) and middleware, shall not be required to secure a Permit to Use (PTU). Instead, the system must be registered:
- Registration Requirement: Taxpayers must register the “System” by submitting the required documentary requirements stated on the “Checklist of Documentary Requirements” (CDR) to the Revenue District Office (RDO) where they are registered.
- No BIR Form 1900 or Pre-Evaluation: BIR Form No. 1900 is no longer required for the submission of the application for registration of the “System”. Crucially, System demonstration or pre-evaluation shall not be required prior to the use of the “System”.
- Acknowledgement Certificate: Upon submitting the complete documentary requirements, an Acknowledgement Certificate shall be issued within three (3) working days from receipt by the RDO. Therefore, a PTU for CAS, CBA, and/or components shall no longer be required for the use and registration of the “System”.
Compliance and Validation
While the initial process is simplified, compliance remains critical and is enforced through auditing:
- Post-Evaluation: The “System” must comply with the standards set forth under Annex “B” of the Circular. A post-evaluation shall be conducted by the concerned RDO to determine if the registered “System” complies with these standards.
- Penalties: If violations of the set standards are discovered during post-evaluation or audit, the taxpayer-user shall be subject to penalties provided under RMO No. 7-2015 and other existing revenue issuances.
- Existing PTUs Remain Valid: Taxpayers who already have an existing approved PTU for their CAS, CBA, and/or its components shall NOT be required to apply for registration. However, the approved PTU is invalid if it was revoked due to non-compliance found during audit/post-evaluation or if a major system enhancement or upgrade exists.
Maintaining Registration for Enhanced Systems
Due to continuous software improvement, taxpayers must understand the guidelines regarding system upgrades:
- Major System Enhancement: In case of a major system enhancement or upgrade, the taxpayer must submit a new application for registration of the “System”. Examples of major enhancement include a change in system functionalities that directly affect the financial aspect (e.g., modified computations), the addition or removal of modules or submodules impacting the financial aspect, or a change in the system/software Version or Release Number that includes enhancements on the financial aspect. If a taxpayer uses an enhanced/upgraded system without prior registration, the originally issued PTU shall be automatically revoked or the registration shall have no effect, and the taxpayer may be subjected to applicable penalty.
- Minor System Enhancement: In case of any minor system enhancement (e.g., user interface modification, bug fixes, performance improvements), the taxpayer must only submit a written notification to their RDO/Large Taxpayers Office stating the specific minor enhancements on the system.
